Each individual sweepstakes will be announced via one or more of Consumer Cellular’s social media accounts (“Sweepstakes Posting”). A Sweepstakes Posting will include how to enter, the entry deadline (if applicable), the method of determining the winner (e.g., random drawing), and the prize(s)/value(s). All information contained in a Sweepstakes Posting is incorporated herein by reference.

By participating in a sweepstakes, you agree to these Official Rules, which are a contract, so read them carefully before participating. Without limitation, this contract includes indemnities to the Sponsor (as defined below) from you, a limitation of your rights and remedies, binding arbitration of claims, waiver of class action claims and waiver to the right to trial by jury.

ELIGBILITY: Open Only to Legal Residents OF THE fifty (50) UNITED STATES AND THE DISTRICT OF COLUMBIA, who are at least 18 years of age AT TIME OF ENTRY. Void Where Prohibited. Employees, officers, directors, managers, agents and representatives (and their immediate families (parent, child, spouse or sibling and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related) of Consumer Cellular, Incorporated (“Sponsor”), its parent, affiliates, subsidiaries and advertising and promotion agencies are not eligible to enter or win. By participating, entrants agree to be bound by these Official Rules and the decisions of the judges and/or Sponsor, which are binding and final on matters relating to any sweepstakes. Sweepstakes are subject to all applicable federal, state and local laws.

TO ENTER: To enter a sweepstakes, follow the directions provided in the Sweepstakes Posting. All entries must be received by the date and time stated in the Sweepstakes Posting to be eligible. Limit one (1) entry per person per sweepstakes, unless otherwise stated in the Sweepstakes Posting. Entries received from any person for a sweepstakes in excess of the stated limitation will be void. Entries generated by script, macro, AI or other automated means or by any means which subvert the entry process, including, but not limited to, the use of multiple or fake accounts on the applicable social media platform, are void. Entries will not be acknowledged by Sponsor. If you do not have the applicable platform account(s), establishing an account is free. All platform terms apply (as applicable). Your account must be set to “public” in order for your entry to be eligible. You can return the applicable account to “private” and, if required to follow the applicable Sponsor’s social media account, “unfollow” same any time after the winner has been announced.

ENTRY REQUIREMENTS: Entry must be in keeping with Sponsor’s image and not be offensive or inappropriate, as determined by Sponsor in its sole discretion. Entry must not defame or violate or infringe upon the rights of any person or entity. Sponsor reserves the right to disqualify any entry and remove any post that it determines, in its sole discretion, is not in compliance with these Official Rules.

WINNER DETERMINATION: Potential winner(s) will either be determined (i) through a random drawing held on or about the day following the entry end date set forth in the Sweepstakes Posting from all eligible entries received, or (ii) based on the timing of the receipt of the entry (i.e., first 10 eligible entries received). Exact winner determination process will be stated in the Sweepstakes Posting. Odds of winning depend on the number of eligible entries received. Potential winner(s) will be notified by direct message, @reply, or comment on entry and may be required to execute and return an affidavit (or declaration) of eligibility, a liability release and, where lawful, a publicity release within three (3) days of date of issuance. If such documents are not returned within the specified time period, prize notification is returned as undeliverable, or a potential winner is not in compliance with these rules, prize will be forfeited and, at Sponsor’s discretion, an alternate winner selected. If any winner is at least 18 but still considered a minor in their jurisdiction, Sponsor reserves the right to award the prize to their parent or legal guardian and/or otherwise require that their parent or legal guardian fulfill the winner requirements set forth herein.

PRIZE(S): The prize(s) and their approximate retail value(s) will be set forth in the Sweepstakes Posting.

Actual value of any autographed item provided as a prize is subject to market fluctuations.

Terms and conditions apply to any gift card provided as a prize.

Service plan is not provided as part of any prize that includes a mobile phone, unless otherwise stated in the Sweepstakes Posting.

If tickets are awarded as a prize, travel to/from event is not included as part of prize, unless otherwise stated in the Sweepstakes Posting. Tickets are subject to terms and conditions specified thereon, including the raincheck policy. Sponsor is not responsible if event is delayed, postponed or cancelled for any reason; no substitution will be provided except as in Sponsor’s sole discretion, and winner will not be reimbursed for tickets. Seating to be determined in the sole discretion of Sponsor. Winner and guest (if applicable) agree to abide by all venue rules and regulations. Failure to do may result in forfeiture of prize.

Prizes are awarded “as is” with no warranty or guarantee, either express or implied. Prizes may not substituted, assigned or transferred or redeemed for cash, however Sponsor reserves the right, at its sole discretion, to substitute a prize (or portion thereof) with one of comparable or greater value. Winners are responsible for all applicable federal, state and local taxes, if any, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided. All prize details are at Sponsor’s sole discretion. Limit one (1) prize per household per sweepstakes.

PUBLICITY GRANT: Each winner, by acceptance of prize, except where legally prohibited, grants permission for Sponsor and its designees to use his/her name, social media handle, address (city and state), photograph (including, without limitation, profile photo), voice and/or other likeness and prize information for advertising, trade and promotional purposes without further compensation, in all media now known or hereafter discovered, worldwide in perpetuity, without notice or review or approval.

LIABILITY RELEASE: Entrants, by participating, agree that Sponsor, Meta Platforms ( dba Instagram and Facebook), X Corp, TikTok, Inc., Google LLC (dba YouTube), and their respective parent, affiliates, subsidiaries and advertising and promotion agencies and all of their respective officers, directors, employees, managers, representatives and agents (collectively, “Released Parties”) will have no liability whatsoever for, and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of anyprize (including, when applicable, any travel related thereto) or participation in a sweepstakes. Released Parties are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, undelivered or garbled entries, posts, comments, other social actions, email, or other communications of any kind; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with a sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of a sweepstakes, the processing of entries, the announcement of the prize(s) or in any sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in a sweepstakes. Released Parties are not responsible for injury or damage to entrants' or to any other person's device related to or resulting from participating in a sweepstakes or downloading materials from or use of any platform or app.

GENERAL CONDITIONS: Persons who tamper with or abuse any aspect of a sweepstakes, platform, or app or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void.

Sponsor reserves the right at its sole discretion to suspend, modify or terminate a sweepstakes at any time and for any reason, including, but not limited to, should any portion of the sweepstakes be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, and, if terminated, at its discretion, select the potential winner(s) from all eligible, non-suspect entries received for that sweepstakes prior to action taken or as otherwise deemed fair and appropriate by Sponsor.

Only the type and quantity of prizes described in the Sweepstakes Postings will be awarded. In no event will more prizes be awarded than set forth in the Sweepstakes Posting. If, due to printing, digital, computer programming, hardware or software, or production errors or for any reason, more potential winners come forward seeking to claim prizes in excess of the number of prizes set forth in the Sweepstakes Posting, the winner of the prize may be selected in a random drawing from among all persons making purportedly valid claims for the prize. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances.

In the event of a dispute regarding entries received from multiple users having the same e-mail or social media account, the authorized subscriber of the e-mail account or social media account at the time of entry will be deemed to be the entrant and must comply with these Official Rules. Authorized account subscriber of the e-mail account is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses. Authorized account subscriber of the social media account is the natural person who is assigned the social media account by the applicable platform.

The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Headings and captions are used in these Official Rules solely for ease of reference and shall not be deemed to affect in any manner the meaning or intent of these Official Rules or any provision hereof. These Official Rules cannot be modified or amended in any way except in writing by the Sponsor.

DISPUTES/CHOICE OF LAW: Except where prohibited, entrants agree that:

(1) any and all disputes, claims and causes of action arising out of or connected with the sweepstakes (including any and all disputes, claims and causes of action arising out of or connected with the prize, the availability or use or same; or the conduct of a sweepstakes), shall be resolved individually, without resorting to any form of class action, and exclusively by arbitration pursuant to the Rules of the American Arbitration Association, then effective (provided that, if for any reason AAA declines to administer the arbitration, the dispute may be arbitrated before JAMS, Inc. or another mutually agreed upon arbitration service pursuant to its own rules for expedited consumer arbitration); and

(2) they will waive any right to seek or obtain injunctive or other equitable relief (provided that nothing in these Official Rules will restrict a California resident’s right under applicable law (if any) to seek public injunctive relief otherwise in accordance with the requirements of this provision); and

(3) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering sweepstakes (if any), but in no event attorneys’ fees; and

(4) under no circumstances will an entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, special, exemplary and consequential damages and any other damages, other than for actual out-of-pocket expenses (if any), and any and all rights to have damages multiplied or otherwise increased.

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and/or Sponsor in connection with a sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Arizona, without regard for conflicts of law doctrine of Arizona or any other jurisdiction, and all proceedings shall take place in Maricopa County, Arizona (except where otherwise required by the applicable arbitration rules).

WINNERS’ LIST: The name(s) of the winner(s) (first name, last initial and state of residence) for a specific sweepstakes will be announced via the same platform as the Sweepstakes Posting or you can send a direct message to Sponsor’s social handle on that platform to request same within 30 days of the end of the applicable sweepstakes.
